Il caso venne portato davanti al Comitato delle Nazioni Unite contro la tortura, che non solo ha ordinato il risarcimento per l\u2019<a href=\"https:\/\/www.open.online\/temi\/violenza-sessuale\/page\/2\/\">abuso sessuale<\/a>, ma ha deciso di istituire un piano nazionale di risarcimento dei crimini di guerra.<\/p>\n\n\n<p class=\"wp-block-paragraph\">La donna, la cui identit\u00e0 non \u00e8 stata svelata per proteggerla, venne stuprata vicino a Sarajevo durante il conflitto avvenuto tra il 1992 e il 1995, e in cui persero la vita oltre 100mila persone. Il suo aggressore fu condannato a risarcirla di 15mila euro, soldi che l\u2019uomo neg\u00f2 di avere. Cos\u00ec, il Comitato ha stabilito che a risarcire la donna dovr\u00e0 essere lo Stato.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Secondo il Comitato delle Nazioni Unite, infatti, la Bosnia ha violato&nbsp;<a href=\"https:\/\/www.unhcr.it\/wp-content\/uploads\/2016\/01\/Convenzione_contro_la_Tortura.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">la Convenzione Onu contro la tortura<\/a>. Per questo ora deve procedere a un risarcimento tempestivo, equo e adeguato alla donna, oltre a fornirle cure mediche e psicologiche gratuite.&nbsp;<\/p>\n\n\n<p class=\"wp-block-paragraph\">\u00abConsideriamo questa decisione rivoluzionaria, non solo per la Bosnia, ma anche a livello globale perch\u00e9 l\u2019Onu ha preso una decisione di tale portata su una denuncia di una vittima di violenza sessuale\u00bb, ha detto Adrijana Hanusic Becirovic, consulente legale senior di&nbsp;<em><a rel=\"noreferrer noopener\" href=\"https:\/\/trialinternational.org\/\" target=\"_blank\">Trial International<\/a><\/em>, organizzazione no profit che si batte contro l\u2019impunit\u00e0 in ambito internazionale.&nbsp;<\/p>\n\n\n<p class=\"wp-block-paragraph\">Secondo uno studio portato avanti dalla ministra dei diritti umani e dei rifugiati della Bosnia Saliha Djuderija,\u00a0<a href=\"https:\/\/balkaninsight.com\/2015\/09\/29\/bosnian-rape-victims-still-waiting-for-justice-09-28-2015\/\">sarebbero almeno 20mila le donne vittime di violenza sessuale<\/a>\u00a0usate come strumento di guerra nella Bosnia degli anni Novanta.
